燃思辨之火，看谁“语”争锋？2022年5月9日晚利群所第三届青年律师辩论赛在律所学术报告厅拉开帷幕。

    本次比赛由利群所副主任蔡辉强律师、郑晓丹律师、黄道进律师，及合伙人张梁律师、张文中律师担任评委。

辩    题

十一岁的李某在没有使用手机软件的情况下，打开了上锁的共享单车，逆向行驶在公路上。这时王某驾驶的普通轻型货车，以十公里每小时的速度右转，由于双方疏忽，都没有发现对方。导致李某骑行的自行车遭到碾压，当天李某抢救无效，死亡。

李某父母十分痛苦，后想到共享单车没有标明十二岁以下的儿童不能骑行，有不可推卸的责任，便将共享单车公司起诉至法院。

经法院调查发现：

1.该共享单车旗下所有共享单车均未标明十二岁以下儿童不能骑行。

2.涉案共享单车不存在故障，且后台程序显示，该共享单车在骑行前为上锁状态。对于涉案共享单车如何被打开的，无法调查清楚。

3.网络上能查询到数个针对该共享单车公司旗下的共享单车能够不使用手机软件开锁的攻略。

This competition will be judged by Lawyers Cai Huiqiang, Zheng Xiaodan, Huang Daojin, Deputy Director of Liqun Institute, as well as Lawyers Zhang Liang and Zhang Wenzhong, as partners.

Debate questions

Eleven year old Li opened the locked bike sharing without using mobile phone software and drove Wrong-way driving on the road. At this moment, the ordinary light truck driven by Wang turned right at a speed of ten kilometers per hour, but due to negligence on both sides, they did not notice each other. The bicycle that Li was riding was crushed, and on the same day, Li's rescue was ineffective and he died.

Li's parents were in great pain and later realized that the shared bicycle company had an unshirkable responsibility for not indicating that children under the age of twelve cannot ride it. Therefore, they sued the shared bicycle company to the court.

After investigation by the court, it was found that:

1. All shared bicycles under this shared bicycle flag are not marked as non cycling for children under the age of twelve.

2. The shared bike involved in the case does not have any faults, and the backend program shows that the shared bike was locked before riding. It is impossible to investigate how the shared bicycle involved was opened.

3. Several strategies for unlocking shared bicycles under the company's shared bicycles without using mobile software can be found online.
