2022年7月24日，台州市律师协会第七届知识产权专业委员会第一次全体会议暨典型案例研讨会在浙江利群律师事务所顺利召开。台州市律师协会副会长项建华、台州仲裁委员会知识产权仲裁院副院长胡梦孜、台州市知识产权保护中心副主任蒋迅、台州市合信公证处主任柯顺瑞以及全体知产委员等60余人参加会议。会议分上下半场，分别由市律协知产委副主任王优飞律师、副秘书长雷蕾律师主持。

一、分管会长发言

会议首先由台州市律师协会副会长项建华上台致辞。他对新一届知识产权专业委员会的成立表示热烈祝贺。

项建华副会长引用习近平总书记关于保护知识产权重要性的论述，强调了知识产权保护工作的重要意义，并指出知识产权法律服务是律师行业的一项重要且相对较新的服务领域，台州律师作为主要服务地方政府和企业的法律职业群体，如何为当地政府和企业提供优质而高效的知产法律服务，应当是知识产权专业委员会要重点关注和研究的课题。

项建华副会长提出，希望各位委员能以本届知产委成立为契机，继承过往优秀传统和做法，继续增进与相关部门的沟通与交流，加强对知识产权相关领域的深入研究和学习，进而提升台州律师整体的知识产权法律服务能力，为地方经济以及国家发展大局贡献智慧和力量。

二、特邀嘉宾发言

台州仲裁委员会知识产权仲裁院副院长胡梦孜上台发言，具体介绍了台州仲裁委员会和知识产权仲裁院的情况，并通报了知识产权仲裁院接下来在知识产权仲裁方面的几项重点工作，并希望知产委律师能对知识产权仲裁工作给予关注和支持。

台州市知识产权保护中心副主任蒋迅介绍了台州市知识产权保护中心的具体情况，指出要协助中小企业增强知识产权保护意识，做好知识产权侵权风险的主动防御工作。并强调，希望知产委之间能加强交流与合作，探索并挖掘有效的方式来帮助企业筑牢知识产权风险防御体系。

台州市合信公证处公证员叶丝丝从合信公证处具体情况、公证服务知识产权保护的主要业务类型、公证在服务知识产权保护中的作用三个方面介绍了公证与知识产权保护。

三、工作计划通报

我所主任、市律协知产委主任毛灵见律师代表利群所作为东道主对与会嘉宾以及全体知产委委员的到来表示热烈欢迎，并提出希望知产委接下来的工作能让全体委员及台州律师在知识产权业务的提升和开拓上有切实的获得感。随后，毛律师向全体参会人员就本届知产委的工作计划进行了通报。

七、典型案例研讨会

本次会议还举办了第一次全体成员典型案例研讨会，王林江、项俊勇、何良雄三位律师从案件介绍、争议焦点和法律分析三个方面对经办的典型案例进行了分享。

王林江律师介绍分享了“驾校联营横向垄断协议案”，该案入选了2021年中国法院年度知识产权十佳案例。

项俊勇律师以“如何外观专利比对的客观性——从一件二审改判胜诉案例说起”为主题作了分享。

何良雄律师分享了“台州某缝纫机电有限公司诉台州某缝纫机有限公司等侵害实用新型专利权纠纷二审改判案”。

研讨期间，知产委委员聚精会神，纷纷通过拍照、笔记等方式对三位律师的精彩分享进行记录，对三个典型案例都有了更深一步的认识，增长了业务知识及实操技能。

八、总结发言

最后，知产委主任毛灵见律师作总结发言。

毛灵见律师简单回顾了三个案例分享的意义，指出他们具有很强的典型性和实操性，体现了台州律师在知识产权诉讼案件中取得的不凡成果与优异品质，同时也提出目前台州律师在知识产权法律服务领域存在的不足和短板。

他强调，知产法律服务要从后端诉讼业务逐渐向前端的保护延伸，不仅在后端要提供诉讼层面的知产服务，在前端也能提供优质法律服务。知产法律服务除了立足国内市场之外，也要向境外延伸，台州是外贸大市，要为台州及国内企业走向国际市场提供知识产权护航。

本次会议全体委员表现出极高的参与度和热情，纷纷表示受益颇多。台州市律师协会第七届知识产权专业委员会将以本次会议为起点，认真履职，勤勉尽责，为台州知识产权律师业务的发展贡献力量。

On July 24, 2022, the first plenary meeting and typical case seminar of the 7th Intellectual Property Professional Committee of the Taizhou Lawyers Association were successfully held at Zhejiang Liqun Law Firm. The meeting was divided into two halves, presided over by Lawyer Wang Youfei, Deputy Director of the Intellectual Property Committee of the Municipal Law Association, and Lawyer Lei Lei, Deputy Secretary General.

1、 Speech by the responsible president

The meeting began with a speech by Xiang Jianhua, Vice President of the Taizhou Lawyers Association. He warmly congratulated the establishment of the new Intellectual Property Professional Committee.

  It should be a topic that the Intellectual Property Professional Committee should focus on and study.

Vice President Xiang Jianhua proposed that all members of the committee can take the establishment of this session of the Intellectual Property Commission as an opportunity to inherit the excellent traditions and practices of the past, continue to enhance communication and exchange with relevant departments, strengthen in-depth research and learning in intellectual property related fields, and thereby enhance the overall intellectual property legal service capacity of Taizhou lawyers, contributing wisdom and strength to the local economy and national development.

2、 Invited guests to speak

Hu Mengzi, Vice President of the Intellectual Property Arbitration Court of the Taizhou Arbitration Commission, gave a speech on stage, specifically introducing the situation of the Taizhou Arbitration Commission and the Intellectual Property Arbitration Court. He also reported on several key tasks of the Intellectual Property Arbitration Court in intellectual property arbitration, and hoped that the lawyers of the Intellectual Property Commission could pay attention to and support the work of intellectual property arbitration.

Jiang Xun, Deputy Director of Taizhou Intellectual Property Protection Center, introduced the specific situation of Taizhou Intellectual Property Protection Center and pointed out the need to assist small and medium-sized enterprises in enhancing their awareness of intellectual property protection and actively defending against intellectual property infringement risks. And it is emphasized that we hope to strengthen communication and cooperation between the Intellectual Property Commission, explore and explore effective ways to help enterprises build a strong intellectual property risk defense system.

Ye Sisi, a notary at the Hezin Notary Office in Taizhou City, introduced notarization and intellectual property protection from three aspects: the specific situation of the Hezin Notary Office, the main types of notarization services for intellectual property protection, and the role of notarization in serving intellectual property protection.

3、 Work Plan Notification

Our director and director of the Intellectual Property Committee of the Municipal Lawyers Association, Mao Lingjian, represented by lawyer Li Qun as the host, warmly welcomed the guests and all members of the Intellectual Property Committee, and expressed the hope that the next work of the Intellectual Property Committee can give all members and Taizhou lawyers a practical sense of achievement in improving and expanding their intellectual property business. The second half of the meeting kicked off with the self introduction of professional committee members.

7、 Typical Case Seminar

This meeting also held the first typical case seminar for all members. Lawyers Wang Linjiang, Xiang Junyong, and He Liangxiong shared the typical cases handled from three aspects: case introduction, dispute focus, and legal analysis.

Lawyer Wang Linjiang introduced and shared the "Horizontal Monopoly Agreement Case of Driving School Joint Venture", which was selected as one of the top ten intellectual property cases in Chinese courts in 2021.

Lawyer Xiang Junyong shared the theme of "How to Objectively Compare Appearance Patents - Starting from a Successful Case of Second Trial Adjudication".

Lawyer He Liangxiong shared the case of the second instance amendment of a dispute over the infringement of utility model patent rights by a sewing machine limited company in Taizhou against a sewing machine limited company in Taizhou.

During the seminar, members of the Intellectual Property Commission focused their attention and recorded the wonderful sharing of the three lawyers through photography, notes, and other means. They gained a deeper understanding of the three typical cases and increased their business knowledge and practical skills.

Lawyer Mao Lingjian briefly reviewed the significance of sharing three cases, pointing out that they have strong typicality and practicality, reflecting the extraordinary achievements and excellent quality of Taizhou lawyers in intellectual property litigation cases. At the same time, he also pointed out the shortcomings and shortcomings of Taizhou lawyers in the field of intellectual property legal services.

He emphasized that intellectual property legal services should gradually extend from backend litigation business to front-end protection, not only providing litigation level intellectual property services in the backend, but also providing high-quality legal services in the front-end. Intellectual property legal services should not only be based in the domestic market, but also extend overseas. Taizhou is a major foreign trade city, and should provide intellectual property protection for Taizhou and domestic enterprises to enter the international market.

All members of this meeting demonstrated high levels of participation and enthusiasm, and expressed their significant benefits.
