2019年11月8日上午，椒江区人民检察院副检察长陈常、刘柏良，第一检察部主任徐敏，第二检察部主任丁建华等一行莅临利群所，调研和交流认罪认罚案件相关事宜。椒江区法律援助中心主任许建华、副主任盛莉莉一起参加调研。我所高级合伙人李宏飞、张卫娟律师，刑事部副主任张梁等刑事部十多位律师及君安世纪台州分所齐华修律师、海豪所吴华律师、建策所翁利亚律师也参与本次座谈。

座谈交流前，陈常、刘柏良副检察长等一行在我所王新平主任、郑晓丹副主任的带领下，参观了律所办公环境，并对新办公室布局、功能给予高度评价。

此次座谈会，主要围绕律师在办理认罪认罚案件法律帮助工作中的定位、作用及碰到的困难三方面展开。与会人员积极发言，场面活跃。

各位律师从阅卷、会见时间，羁押必要性审查，如何确保真心认罪认罚的效果等各个方面提出了自己的见解。

椒江区人民检察院副检察长陈常指出值班律师制度对于促进司法机关依法公正办案的重要性，希望司法行政机关、值班律师与检察院在司法办案过程中加强沟通，边实施边研究，尽快落实好值班律师制度。并强调，要及时把平时遇到的问题要提出来，固定下来，确保认罪认罚制度出实效。

椒江区法律援助中心主任许建华谈及伴随着认罪认罚制度的深入开展和案件数量的不断增多，值班律师制度在实施初期所遇到的一些困难，并介绍了如何从制度“破立”到适用比率稳步上升的经验。最后表示：会将各位律师提出的问题和建议进行汇总，及时和检察院做好协调工作，争取共同把制度经营好。

On the morning of November 8, 2019, Chen Chang and Liu Bailiang, deputy chief procurators of the People's Procuratorate of Jiaojiang District, Xu Min, director of the first procuratorial department, Ding Jianhua, director of the second procuratorial department, and other officials visited Liqun Institute to investigate and exchange matters related to cases of confession and punishment. Xu Jianhua, the director of the Jiaojiang District Legal Aid Center, and Sheng Lili, the deputy director, participated in the survey together. Our senior partners, lawyers Li Hongfei and Zhang Weijuan, deputy director of the Criminal Department, Zhang Liang, and more than ten lawyers from the Criminal Department, as well as lawyers Qi Huaxiu from Jun'an Century Taizhou Branch, Wu Hua from Haihao Institute, and Weng Liya from Jiance Institute, also participated in this discussion.

Before the discussion and exchange, Chen Chang, Deputy Prosecutor General Liu Bailiang, and a delegation led by Director Wang Xinping and Deputy Director Zheng Xiaodan visited the office environment of the law firm and gave high praise to the layout and functions of the new office.

This symposium mainly focuses on the positioning, role, and difficulties encountered by lawyers in legal assistance in handling cases of confession and punishment. The attendees actively spoke and the scene was lively.

Lawyers have put forward their opinions on various aspects such as reviewing papers, meeting times, reviewing the necessity of detention, and how to ensure the effectiveness of sincere confession and punishment.

Chen Chang, Deputy Procurator General of the People's Procuratorate of Jiaojiang District, pointed out the importance of the lawyer on duty system for promoting judicial organs to handle cases fairly according to law. He hoped that judicial administrative organs, lawyers on duty and the procuratorate would strengthen communication in the process of handling cases, study while implementing, and implement the lawyer on duty system as soon as possible. And it is emphasized that problems encountered in daily life should be promptly raised and fixed to ensure the effectiveness of the confession and punishment system.

Xu Jianhua, director of the Jiaojiang District Legal Aid Center, talked about some difficulties encountered by the on duty lawyer system in the initial stage of implementation with the in-depth development of the system of confession and punishment and the increasing number of cases, and introduced the experience of how to steadily increase the application rate from the "breaking" of the system. Finally, we will summarize the issues and suggestions raised by all lawyers, coordinate with the procuratorate in a timely manner, and strive to jointly manage the system well.
