在讲座中,利群所蒋晓红律师以“司法实务中用工合同的区分及风险防范”为主题,介绍了企业用工模式的种类,通过以案释法的方式讲解了劳动与劳务关系的利弊、区分标准以及风险防范,并提醒各企业在用工管理过程中要遵守《劳动法》、《劳动合同法》等相关法律规定,规范公司制度及相关劳动制度,构建和谐稳定的劳动关系。

接着,大童保险销售服务有限公司台州营业部负责人丁黎以“不能单买工伤了怎么办”作为本次讲座主线,通过典型案例,深入剖析了企业家遇员工工伤事故,企业所承担的赔偿责任。帮助企业家区分商保险种,充分了解险种的特性,进而正确认识商业保险。

讲座结束后,利群所高级合伙人李昌华律师、张文中律师,以及蒋晓红律师、李亚芬律师、杨良青律师分别开设咨询室为企业负责人们提供一对一的法律咨询服务。

现阶段,由于不能单独缴纳工伤险,如缴纳有工伤保险的,必须同时为职工办理养老保险的问题成为了人员密集型企业的困惑。利群律师们就企业负责人提出的“雇主责任险细节事项、如何通过合规渠道降低用工成本等问题给予耐心解答,并提出指导性建议。

最后,希望企业在面对单独工伤保险向商业保险调整的过程中,必须意识到政策的大环境方向。在用雇主责任险替代工伤险而不大幅增加社保成本的前提下,是当前的经济方法,但仍需有意识的将提升员工参保率作为将来的一项规划。

In the lecture, Lawyer Jiang Xiaohong from Liqun Institute introduced the types of employment models in enterprises with the theme of "Differentiation and Risk Prevention of Employment Contracts in Judicial Practice". Help entrepreneurs distinguish between commercial insurance types, fully understand the characteristics of insurance types, and then have a correct understanding of commercial insurance.

At present, due to the inability to pay work-related injury insurance separately, the issue of having to simultaneously provide pension insurance for employees who have paid work-related injury insurance has become a puzzle for personnel intensive enterprises. Liqun lawyers patiently answered the questions raised by business leaders regarding details of employer liability insurance and how to reduce employment costs through compliance channels, and provided guidance suggestions.

Finally, it is hoped that enterprises must be aware of the overall environmental direction of policies in the process of adjusting individual work-related injury insurance to commercial insurance. Replacing work-related injury insurance with employer liability insurance without significantly increasing social security costs is the current economic approach, but it is still necessary to consciously consider increasing employee participation rates as a future plan.
